Contractual Terms

Affiliation Program of Fifth Avenue provides a request by the applicant Partners (henceforth referred to as’ Affiliated ‘), by completing the form available in the section’ Registration ‘. The subscription form membership in the tacit acceptance of the terms of the agreement

Agreement Terms

the Affiliation Program of Fifth Avenue aims to create a collaborative relationship between Fifth Avenue Affiliates requesting them. The aim is to forge a bond aimed at ensuring mutual benefits. The request for subscription and membership of the agreement are completely free and no burden of economic present and future.

Fifth Avenue undertakes to pay € 10.00 as ‘Registration Bonus’ at the time of acceptance of the franchisee registration (which will be recognized once and only at the time of registration), and commissions reported in the table for every purchase, successful concluded by visitors from affiliated sites by clicking on our links, banners and other types of alerts, according to the following table:

Your purchase will be considered successful when the buyer has made regular payment of the due amount in Fifth Avenue, and 11 days have elapsed from the payment.

The gained commissions will be cleared within 15th day of the month following the purchase confirmation, provided there is a credit of at least 100 euros in its own account. The Affiliate can not make claims on products purchased and eventually credited transited from its site. The amount will be credited initially reversed by our operator. For their protection, the franchisee will be aware of the code of customer’s purchase. The agreement provides for the compilation so by Request Affiliate form (electronic form for membership) and the acceptance of commitments and clauses contained in it. Once completed and signed the form, press the SEND button to transmit it to Fifth Avenue. Fifth Avenue reserves the right to legal proceedings.

Will not be taken into consideration requests for websites with content that is obscene, pornographic, illegal, of poor quality. Will not be taken into consideration also sites that may in any way harm the image of the company Fifth Avenue. In this sense Fifth Avenue reserves the right to withdraw at any time, the agreement of affiliation, where the terms agreed are not respected, and the right to refer it to legal action, in circumstances where the conditions occur.

Rights and duties the franchisee

Once accepted the application, the Applicant becomes Affiliated to Fifth Avenue and receives a communication by e-mail with passwords to access the control panel. The Affiliate has absolute prohibition on carrying out SPAM activities or external to its website. If the Affiliated incur in technical or other problems, is required to contact the Fifth Avenue staff, in order to solve the problem under common goal to continuously ensure the proposed service. It is strictly prohibited to promote products and services of Fifth Avenue through spam, reports on newsgroups, chain letters, emails sent without prior authorization from the recipient, and any other submissions outside of its website and / or . In which case the franchisee intends to make an alert outside their own website and/or its or newsletters will do so only after prior written authorization of Fifth Avenue. Failure to comply with this clause involves the immediate cancellation of the Franchisee and the right to compensation for damages.

Privacy protection

Fifth Avenue undertakes to protect the privacy of its Affiliates under the former. Art. 10 law 675/96. The collected data are used exclusively by Fifth Avenue and will not be disclosed to third parties without permission. They will be used solely for informational purposes for , offers and promotions. Fifth Avenue has an obligation to cooperate with the authorities in situations where laws or procedural rules require to provide the Affiliate information.

Possible disputes

Fifth Avenue is not responsible for any disruptions caused by technical errors or extraordinary events outside the will of the company. Jurisdiction for any dispute relating to this contract or the relationship between Affiliate and Fifth Avenue will be the of Prato (Italy).

Agreement duration

Your agreement provides for a period of 1 calendar year. To withdraw from Affiliation Program will be necessary to give notice to Fifth Avenue at least 30 (thirty) days before the expiry of the agreement, by mail or by registered receipt return. The letter should be forwarded to Fifth Avenue c/o Fifth Avenue, via Baciacavallo 1 / d, 59100 Prato. In the absence of notice, the contract will be tacitly reconfirmed.

Subscription is absolutely free: just after you subscribe, you can enter your control panel, where you can find all the links and banners to promote on your website!

You will receive a 10,00 € Bonus for your subscription to the affiliation program. This Bonus will be immediately credited onto your account, and you can see it in your “affiliate control panel”. You will be able to withdraw when you will reach the minimun commission amount of € 100,00 in other words, you only have to produce € 90,00 of commissions and you will withdraw your € 100,00.
